Store regulations
I. GENERAL CONDITIONS OF SALE
1. The website ‘iwchome.com’ hereinafter referred to as the ‘IWC HOME Online Shop’ is owned by IWC HOME Sp. z o.o., ul. Warszawska 28, Spalice, 56-400 Oleśnica, NIP 911-202-53-17, REGON 36895348500000.
2. The online shop sells goods via the web. Deliveries of goods ordered through the ‘IWC HOME online shop’ are made only within the territory of the Republic of Poland. The party making purchases in the ‘IWC HOME online shop’ may be: natural persons, legal persons or organizational units without legal personality, hereinafter referred to as ‘Client’.
3. The prices shown on the pages of the ‘IWC HOME Online Shop’ valid on the day of ordering are valid from the day of ordering until the day of order fulfilment.
4. All prices are in Polish zloty and include VAT.
5. The company reserves the right to refuse an order in special cases, e.g. if an incorrect price is entered for an item in the online shop or in an e-mail offer.
6. Orders for goods are placed by customers on the website of the ‘IWC HOME online shop’ by filling in the appropriate form.
7. The server of the ‘IWC HOME Online Shop’ automatically sends an email to the Customer to obtain confirmation of the order placed when paying cash on delivery. The message referred to in the preceding sentence will contain information on the amount and cost of delivery.
8. The processing of the order placed begins when the customer confirms his order by e-mail and pays for the goods by traditional transfer, electronic transfer or credit card in an electronic payment system. In the case of instalments, upon receipt of a positive credit decision.
9. The date of payment is the date on which the money is credited to the account of the ‘IWC HOME Furniture Store’. The payment must reach the account of the ‘IWC HOME Furniture Store’ no later than 7 days after the order is placed. After the ineffective expiry of the 7-day period for payment, the order is cancelled and will not be binding for the ‘IWC HOME Furniture Store’.
10. The lead time of the order is indicated on the page of the selected goods and is calculated from the date of fulfilment of the conditions contained in section 9 of these terms and conditions, unless the Customer wishes them to be delivered at a later date. The order lead time is the time taken by the production to complete the order, to this lead time must be added the time of delivery of the goods from 7-14 days (if the customer orders furniture with delivery to the indicated address). In this case, a Customer Service person will contact the customer directly to arrange a delivery date. The delivery date of the furniture may be longer than the date agreed with the Customer, for reasons attributable to the carrier, but it will not be longer than 14 days of which we will inform the Customer in advance. The Customer assesses at his own risk the possibility of bringing the furniture to the place of delivery, taking into account that the service will be carried out by two people. The cost of storage, from the date of receipt of information about the completed order, is: up to 14 days - free of charge, over 14 days - PLN 15 net/day.
11. The date of ‘scheduled delivery of the day’ is an estimated date, subject to the availability of individual production raw materials. In the event of component shortages, the deadline set may be subject to change (delay), of which the customer will be informed immediately.
12. If the Customer places or confirms an order on a non-working day, the deadline specified above shall start on the next working day. The costs and deadlines for delivery and installation can be found under ‘Transport and installation’. A VAT invoice by name or for a company will contain the details that the Customer provides when placing the order and will be enclosed with the package.
13. The Contractor shall not be liable for delays in the completion of the work that are caused by force majeure and as a result of circumstances beyond the control of IWC HOME.
14. By paying for the order, the Purchaser confirms the accuracy and reliability of the data contained therein, as well as the fact that he has familiarised himself with the technical and visual characteristics of the Work.
15. The Ordering Party declares that it has been informed by the Contractor that there may be slight differences in shades in the materials it selects, including: fabric, leather, wood, quartz sinter, in relation to those in the sample books.
16. Contractor, resulting from the specifics of the production batch.
II. RETURNS
1. Pursuant to the Consumer Rights Act of 25 December 2014 (Journal of Laws 2014, item 827, as amended), the right of withdrawal from an off-premises or distance contract does not apply to consumers in respect of contracts:
a) for the provision of services where the trader has supplied a service in full with the express consent of the consumer who has been informed before the performance of the service by the trader that he will lose his right of withdrawal after the trader has provided the service;
b) in which the object of the performance is a non-refabricated item produced to the consumer's specifications or intended to meet the consumer's individual needs.
2. The Purchaser shall be entitled to withdraw from the concluded contract for the execution of the Work (furniture order) provided that a statement to this effect is made (by e-mail) within 2 days of the conclusion of the contract and after obtaining the consent of the Contractor.
3. As IWC HOME performs the ordered work to the specifications specified by the client, returns or exchanges of properly manufactured furniture are not possible.
III. COMPLAINTS
(apply only to Customers who are consumers, as defined by Article 221 of the Civil Code) The goods are subject to a thorough quality check before being sent to the Customer.
1. Complaints will be considered on the basis of a completed complaint form sent via the Internet, which can be found on the iwchome.com website, or on the basis of a written declaration by the Customer. Complaints will be considered within 14 days from the date of receipt of the complaint by the ‘IWC HOME online shop’.
2. In the event of a justified complaint, the defective goods will be repaired or replaced with new goods, provided that the defect is material.
3. Complaints submitted in writing should be sent by post to: IWC HOME customer service department ul. Warszawska 28, Spalice, 56-400 Oleśnica or by e-mail to shop@iwchome.com.
4. The written statement, signed by the complainant, should state:
- your name,
- date of purchase and order number,
- exact address (street, house number, code, town),
- name, numbers, quantity of the goods which are the subject of the complaint,
- the reason for the complaint.
5. The Complaints Department will consider the validity of the complaint within a maximum of 14 days of receipt. Information on the acceptance or rejection of the complaint will be sent to the Customer (being a consumer) to the address provided in the complaint form. If the complaint is accepted, an employee of the Complaints Department will contact the Customer in order to determine the date and procedure for settling the claim.
6. Any doubts about complaints can be clarified at the e-mail address shop@iwchome.com or at the telephone number +48 530 457 457.
7. Complaints will be handled by IWC HOME without delay, however no longer than within 14 working days counted from the date of receipt of the complaint application, provided that the required documentation is provided, i.e. a complaint form and photos or a video showing the defect of the advertised product on the basis of which a final opinion can be issued. The delivery of incomplete documentation will result in postponing the aforementioned deadline.
8. If the complaint is accepted, IWC HOME undertakes to repair the defective Furniture or replace it free of charge or reduce the payment for the Work.
9. The Contractor shall not be liable for defects or faults in the Work resulting from the actions of the Customer or third parties, resulting in particular from improper use of the Furniture.
10. Natural moles, heterogeneity in its structure and shiny areas within one set are not considered a defect in the leather covering.
11. Insignificant differences in colouring and natural veneers which may occur in relation to the samples presented to the purchaser at the time of concluding the contract and which are due to the natural diversity of the grain and structure of the wood and its differing absorption of colour are not regarded as defects in the wood.
12. The ordering party confirms that it has been informed that differences in the hardness of individual elements in upholstered furniture are determined by the constructional solutions, as well as the size of the individual elements and the type of upholstery fabric used.
13. Due to the varying properties of the materials used in the manufacture of the work, the purchaser declares that he accepts that there may be differences in the actual dimensions, of the upholstered elements (from 0 to 4 cm) in relation to the dimensions stated in the manufacturer's information sheets and on the display.
14. Some fabrics, especially velvet fabrics, shimmer in the light and, depending on the angle of incidence, may give the false impression of differences in the shade of the fabric (this is not a defect but merely a characteristic of the product).
15. Deformations resulting from the use of furniture, such as, shifting of the foams inside the furniture, are normal. They can be compensated for by manual repositioning to restore the original shape.
16. Damage caused by sitting on the backrest, headrest or armrest is not subject to a claim, it is damage caused by incorrect use.
17. The effects of improper attempts to clean the furniture and persistent dirt are not subject to claims.
18. Damage caused by the purchaser's own modifications or modifications carried out on the purchaser's behalf will not be claimed.
19. Only clean furniture is accepted for complaint repair. The service technician receiving the complaint furniture has the right to refuse to accept it if it is not sufficiently prepared for repair, in which case the customer delivers the furniture at his own expense or pays the transport costs.
20. As a result of transport, irregular shapes/creases in the furniture may occur after unpacking, which should return to their original shape within a few days after unpacking. This process can be speeded up by manually arranging/rubbing the furniture.
21. Furniture should be protected from direct exposure to sunlight, as this may result in partial fading of the fabric.
22. Furniture should not be placed in close proximity to heat sources.
23. Wrinkling and creasing of both covers and backrest cushions are due to normal use and are not product defects. The larger the surface of the seats and backrests, the greater the tendency to crease and fold. It is advisable to smooth the surface of the seat and back cushions after prolonged use.
24. The occurrence of piling, known as ‘fleecing’, in woven fabrics is a natural phenomenon that occurs when loose fibres begin to loosen from the surface of the fabric until, over time, abrasion by external factors causes these fibres to form small spherical bundles anchored in the fabric.
IV. PROTECTION OF PERSONAL DATA
1. Pursuant to the Personal Data Protection Act of 29 August 1997 (consolidated text: Journal of Laws No. 101 of 2002, item 926, as amended), the owner of the IWC HOME Internet Shop informs that the Customers' personal data are stored in a data filing system of IWC HOME with its registered office at ul. Warszawska 28, Spalice, 56-400 in Oleśnica.
2. Personal data will only be collected and processed for the purpose of processing orders placed by the Customer in the IWC HOME Online Shop.
3. Each Customer has the right to inspect his/her data, to correct, to request the cessation of processing and to have the data deleted, and has the right to object, which must be reported to IWC HOME's head office.
4. IWC HOME ensures that all information and data provided by the Customer through the iwchome.com website will remain confidential and appropriately secured.
5. Placing an order in the ‘IWC HOME Online Shop’ implies acceptance of the provisions of these terms and conditions as in force on the day the Customer places the order.
6. The material provisions of the contract to be concluded shall be recorded, secured and made available to the Customer by printing out and forwarding the VAT invoice together with the consignment.
7. In case of doubt, the contract of sale shall be deemed to have been concluded between the Customer and the owner of the ‘IWC HOME Internet Shop’ as soon as the Customer has confirmed the order referred to in section I, paragraphs 8-11 of these Terms and Conditions.
8. The law applicable to the contract of sale of goods between the IWC HOME Online Shop and the Customer is Polish law, in particular the provisions of the Act of 2 March 2000 on the protection of certain consumer rights and liability for damage caused by dangerous products (Journal of Laws 2000, No. 22, item 271 as amended) and the Act of 30 May 2014 on consumer rights (Journal of Laws 2014, item 827).
9. The competent court for disputes arising from the sales contract shall be the court of general jurisdiction.
10. These Regulations are effective as of 01 August 2016.
