TERMS AND CONDITIONS

 

GENERAL TERMS AND CONDITIONS OF SALE

  1. By signing the order document, you enter into a purchase contract. The scope of this contract is defined in Art. 627 of the Civil Code (By the contract for a work, the ordering party undertakes to perform a specified work, and the ordering party undertakes to pay remuneration) and the Act of 27 July 2002 on special conditions of consumer sales and amendments to the Civil Code.
  2. Slight differences in the shade of the fabrics and leathers purchased compared to those presented to the Buyer are permitted due to their origin from different production batches.
  3. Natural stains, non-uniformity of structure and shiny areas within one set are not considered a defect in the leather. Slight differences in the colouring of wood and natural veneers in relation to the samples presented to the Purchaser are also permissible, resulting from the natural diversity of grain and structure of the wood and its varied acceptance of dye.
  4. Slight differences in the hardness of individual components of upholstered furniture are possible, depending on the constructional solutions as well as the size of the individual components.
  5. Differences in the actual dimensions of the upholstered elements in upholstered furniture of 0-4 cm in relation to the dimensions given in the manufacturer's information sheets and on display in the showroom, resulting from the properties of the materials used to manufacture the furniture, are permitted.
  6. The buyer declares that he has chosen furniture that meets his expectations and has familiarised himself with the visual and technical conditions and raises no objections in this respect.
  7. The Buyer declares that he has received clear and comprehensible information from the Seller sufficient for the full and correct use of the sold furniture.
  8. The Buyer assesses at his own risk the possibility of bringing the furniture to the place of delivery, taking into account two people when ordering such a service. In the event that the architecture of the building, permanent fixtures in the flat, etc. make it impossible to bring the furniture in its factory packaging, any unpacking or disassembly of the furniture and subsequent assembly can only be done at the Customer's risk. The fee for the above activities is determined individually, depending on the degree of difficulty. Unless otherwise stated, the place of delivery is the Customer's address stated on the order.
  9. Determination of the value of the ordered furniture is made on the basis of the price lists in force on the date of conclusion of the purchase contract.
  10. The term of the order runs from the moment the Seller receives the prepayment amount specified on the order into the Seller's bank account. Payment of the prepayment is a condition for the Seller to proceed with the execution of the contract.
  11. A delay by the Seller in fulfilling the concluded contract, but not longer than 14 working days, shall not be deemed a delay or default in the meaning of the Civil Code.
  12. Unless otherwise agreed by the parties, payment for the ordered furniture is made at the IWC furniture showroom or by bank transfer to the Seller's bank account prior to collection of the goods. The ordered furniture is the property of the Seller until the Seller receives the agreed sales price in full.
  13. From the moment the furniture is handed over to the Buyer or to a carrier organised by the Buyer, the risk of damage, destruction or loss of the furniture shall pass to the Buyer.
  14. If the Buyer wishes to make a complaint about the delivered goods, he must do so by e-mail, stating what the defect is (if possible, with photographic documentation) and when the Buyer found the defect.
  15. In the event of a valid complaint, the goods shall be repaired or replaced in accordance with the contract free of charge.
  16. The parties agree that in the event of an unjustified claim of the purchased goods by the Buyer, the Buyer shall reimburse to the Seller the costs incurred by the Seller in connection with the determination of the claim in their full amount.

INSTRUCTIONS FOR USE OF FURNITURE

  1. Upholstered furniture should be used for its intended purpose.
  2. Do not use sharp tools when unpacking furniture.
  3. Transport may result in creases or irregular folds, which will straighten out over time. It is advisable to shape and straighten cushions, seats or headrests by hand - this will speed up the process of shaping the furniture.
  4. When moving the furniture, do not grasp loose parts or fabric as this may damage the furniture.
  5. Upholstered furniture should stand in rooms where the humidity does not exceed 70%.
  6. Upholstered furniture should be protected from strong sunlight, as this can discolour the upholstery.
  7. Furniture should not be placed in direct contact with heat sources such as fireplaces, cookers or radiators.

TRANSPORT

For the sake of our customers, we provide a service of transportation, lifting and assembly of furniture.

The price of transport, lifting and assembly depends on the following factors:

  • place of delivery
  • conditions of the place of delivery (floor number, lift or no lift),
  • type of furniture.

The Buyer assesses at his own risk the possibility of bringing the furniture to the place of delivery, taking into account two people when ordering such a service. In the event that the architecture of the building, permanent fixtures in the flat, etc. make it impossible to bring the furniture in its factory packaging, any unpacking or disassembly of the furniture and subsequent assembly can only be done at the Customer's risk.
